1.Merchant of Record
Payments for the Service are processed by Paddle.com Market Limited and its affiliates ("Paddle"), our authorized reseller and Merchant of Record. This means that, when you purchase a subscription, Paddle, not MaximusLabs, is the seller of record for that transaction. Your payment contract is with Paddle, and Paddle's Buyer Terms and Refund Policy apply in addition to this Policy.
Paddle is responsible for billing, invoicing, the calculation and remittance of applicable taxes (such as VAT, GST, and sales tax), and for processing any refunds.
Where this Policy, applicable law, and Paddle's policies differ, the highest level of protection required by applicable law will always apply.
2.Subscriptions and Billing
2.1Access to the Service is sold as a recurring monthly subscription, billed in advance at the start of each billing cycle.
2.2Subscriptions renew automatically at the end of each monthly billing cycle at the then-current price, using your selected payment method, until cancelled in accordance with Section 4.
2.3All prices are stated exclusive of taxes. Applicable taxes are calculated and added by Paddle at checkout as required by law. Prices are charged in the currency displayed at checkout.
2.4By subscribing, you authorize Paddle to charge your payment method on a recurring basis for the subscription fees and any applicable taxes, until you cancel.
3.General Refund Position
3.1Except where required by applicable law or expressly stated in this Policy, all fees are non-refundable and non-transferable. This includes fees for the current billing period, whether or not the Service was actively used during that period.
3.2We do not provide refunds or credits for:
- (a)billing periods during which your account remained open but the Service was used only partially or not at all;
- (b)features, capacity, or usage allowances that went unused within a paid period; or
- (c)the remaining portion of a billing cycle following a cancellation (see Section 4).
4.Cancellations
4.1You may cancel your subscription at any time through your account settings within the Service, or by contacting us at [email protected], or via Paddle's order-management portal at paddle.net.
4.2Cancellation stops the next scheduled renewal. Your subscription and access to the Service will remain active until the end of the billing period you have already paid for, after which it will not renew.
4.3Cancelling does not entitle you to a refund of the fees already paid for the current billing period, and no pro-rata or partial-period refunds are provided, except where required by applicable law (see Section 5).
5.Statutory Cancellation and Cooling-Off Rights (Consumers)
5.1If you purchase the Service as a consumer in a jurisdiction that grants a statutory right of withdrawal or cooling-off period, you may be entitled to cancel and receive a refund within that period. As administered by Paddle, these periods include, without limitation, 14 days for the EU, EEA, United Kingdom, Turkey, and Israel, and shorter statutory periods in certain other jurisdictions.
| Jurisdiction | Withdrawal period |
|---|---|
| European Union and EEA | 14 days |
| United Kingdom | 14 days |
| Turkey | 14 days |
| Israel | 14 days |
| Certain other jurisdictions | Shorter statutory periods may apply |
The periods above are those administered by Paddle and are listed without limitation. They are subject to clause 5.2 below.
5.2For digital services that begin immediately, this statutory right of withdrawal is lost once performance has started, where you have given your prior express consent to begin the Service immediately and acknowledged that you thereby lose your right of withdrawal. You provide this consent and acknowledgment at checkout. To the extent the Service has been supplied during the withdrawal period, a refund may be reduced proportionately.
5.3Nothing in this Policy limits or excludes any non-waivable statutory rights you may have as a consumer under the laws applicable to you. Where such rights apply, they prevail over any conflicting term in this Policy.
6.Usage, Credits, and Add-Ons
Where the Service offers any metered usage, prepaid credits, overage, or paid add-ons, amounts corresponding to usage already consumed are non-refundable, and prepaid credits are non-refundable and non-redeemable for cash, except where required by applicable law.
7.When We Will Consider a Refund
Notwithstanding Section 3, we (acting through Paddle) may, at our discretion, issue a refund in the following circumstances:
(a) Duplicate or erroneous charge
You were charged more than once for the same subscription period, or charged in error.
(b) Material technical defect
A verified fault attributable to the Service prevented you from accessing its core functionality for a substantial part of a paid period, and we were unable to resolve it within a reasonable time after you reported it.
(c) Required by applicable law
A refund is required by applicable law.
Requests under (a) or (b) should be submitted within 14 days of the relevant charge. Approval of discretionary refunds is not guaranteed and is assessed case by case.
8.Free Trials and Promotions
Where a free trial or promotional period is offered, you will not be charged during that period. Unless you cancel before the trial or promotional period ends, your subscription will convert to a paid recurring subscription and be billed automatically, after which the terms of this Policy apply in full. Only one trial or promotional offer may apply per customer unless we state otherwise.
9.How to Request a Refund
-
Start with Paddle, this is the fastest route
9.1Because Paddle is the Merchant of Record, the fastest way to request a refund is directly through Paddle Order Support at paddle.net, using the order confirmation you received by email.
-
Or contact us directly
9.2Alternatively, you may contact us at [email protected] with: (i) the email address used for the purchase, (ii) your Paddle order or invoice number, and (iii) a brief description of the reason for your request. We aim to acknowledge refund requests within 5 business days.
-
Then the money is returned to you
9.3Approved refunds are returned to the original payment method. The time for the refund to appear depends on your payment provider and typically takes 5 to 10 business days. Any third-party currency-conversion or bank fees charged by your provider are outside our control and are not separately refundable by us.
10.Chargebacks
If you have a concern about a charge, please contact us or Paddle before initiating a chargeback or payment dispute, so we can resolve it directly.
Chargebacks raised without first contacting us, or in a manner inconsistent with this Policy, may result in suspension or termination of your account, and we reserve the right to contest any chargeback we believe to be unwarranted.
11.Changes to This Policy
We may update this Policy from time to time. Changes take effect when the revised Policy is posted, with an updated "Last Updated" date. Where changes are material, we will take reasonable steps to notify you. The version of this Policy in effect at the time of your purchase governs that purchase.
